A BILL
To provide for the sale of the Woodland Lake Park tract in Apache- Sitgreaves National Forest in the State of Arizona to the town of Pinetop-Lakeside, Arizona.
Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,
SECTION 1. LAND CONVEYANCE, WOODLAND LAKE PARK TRACT, APACHE-SITGREAVES NATIONAL FOREST, ARIZONA.
(a) Conveyance Required.—The Secretary of Agriculture shall convey to the town of Pinetop-Lakeside, Arizona (in this section referred to as the “town”), all right, title, and interest of the United States in and to a parcel of real property, including improvements thereon, consisting of approximately 583 acres in Apache-Sitgreaves National Forest in the State of Arizona and known as the Woodland Lake Park tract, for the purpose of permitting the town to use the parcel as a public park and for other recreational purposes.
(b) Consideration.—As consideration for the conveyance under subsection (a), the town shall pay to the United States an amount equal to the fair market value of the parcel to be conveyed, determined by the Secretary on the basis of continued use of the parcel as a public park and for other recreational purposes rather than on the basis of the highest value use of the parcel.
(c) Description of Property.—The exact acreage and legal description of the real property to be conveyed under subsection (a) shall be determined by a survey satisfactory to the Secretary. The cost of the survey shall be borne by the town.
(d) Reversionary Interest.—During the five-year period beginning on the date the Secretary makes the conveyance under subsection (a), if the Secretary determines that the conveyed real property is not being used in accordance with the purpose of the conveyance specified in such subsection, all right, title, and interest in and to the property, including any improvements thereon, shall revert to the United States, and the United States shall have the right of immediate entry onto the property. Any determination of the Secretary under this subsection shall be made on the record after an opportunity for a hearing.
(e) Additional Terms and Conditions.—The Secretary may require such additional terms and conditions in connection with the conveyance under subsection (a) as the Secretary considers appropriate to protect the interests of the United States. <all>
