Electronic Consent Accountability Act of 2025
To direct certain Federal agencies to report to Congress on whether such agencies have implemented guidance from the Office of Management and Budget with respect to the disclosure of personal information, and for other purposes.
Summary
This bill requires 16 federal agencies to submit a report to Congress within 120 days on whether they have implemented Office of Management and Budget guidance on electronic identity proofing, authentication, and consent for disclosure of personal records. The OMB guidance, issued in November 2020, implemented requirements from the CASES Act to streamline electronic consent for access to personal information. If an agency has not implemented the requirements, the report must include justification, a timeline for implementation, and the steps being taken to implement. The affected agencies include the Departments of Agriculture, Defense, Health and Human Services, Homeland Security, Interior, Justice, Labor, State, Transportation, Treasury, Veterans Affairs, the Environmental Protection Agency, and several other federal agencies. The bill is designed to ensure compliance with modernized electronic consent standards across the federal government.
