Summary

This bill amends the Native American Graves Protection and Repatriation Act (NAGPRA) to extend its protections to Native Hawaiian organizations in addition to Indian tribes. The bill requires that written consent be obtained from lineal descendants or the appropriate Indian tribe or Native Hawaiian organization before Native American human remains can be intentionally excavated or removed for purposes of study. The bill updates notification requirements for inadvertent discoveries of human remains or cultural items to specifically include notification to Native Hawaiian organizations, not just Indian tribes. The bill also specifies that any person or entity that disposes of or controls cultural items must adhere to the applicable requirements under NAGPRA regarding notification and treatment of Native American remains and associated cultural items. These amendments extend the act's protections and procedural requirements to include Native Hawaiians alongside Native American Indian tribes.
