Prevent Tariff Abuse Act

To exclude the imposition of duties and import quotas from the authorities provided to the President under the International Emergency Economic Powers Act.

Introduced Jan 15, 2025

Latest action (Jan 15, 2025) Referred to the Committee on Foreign Affairs, and in addition to the Committee on Ways and Means, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned.

Summary

This bill amends the International Emergency Economic Powers Act to clarify that the President's authority during national emergencies does not include the power to impose tariffs, tariff-rate quotas, or other import quotas on articles entering the United States. The amendment adds a new subsection to Section 203 of the act explicitly excluding these duties and quotas from the President's emergency economic authorities. This limits the President's ability to use emergency powers to impose trade restrictions.
