Mrs. Luna (for herself and Mrs. Miller of Illinois) introduced the following bill; which was referred to the Committee on the Judiciary

A BILL

To increase penalties for crimes against children.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the “No Repeat Child Sex Offenders Act”.

SEC. 2. SEX TRAFFICKING.

(a) Transportation Generally.—Subsection (a) of section 2421 of title 18, United States Code, is amended by striking “or imprisoned not more than 10 years, or both” and inserting “and punished by death or imprisoned for life”.

(b) Promotion or Facilitation.—Section 2421A of title 18, United States Code, is amended—

(1) in subsection (a), by striking “imprisoned for not more than 10 years, or both” and inserting “and punished by death or imprisoned for life”; and

(2) in subsection (b), in the continuation text following paragraph (2), by striking “imprisoned for not more than 25 years, or both” and inserting “and punished by death or imprisoned for life”.

(c) Coercion and Enticement.—Section 2422 of title 18, United States Code, is amended—

(1) in subsection (a), by striking “or imprisoned not more than 20 years, or both” and inserting “and punished by death or imprisoned for life”; and

(2) in subsection (b), by striking “imprisoned not less than 10 years or for life” and inserting “punished by death or imprisoned for life”.

(d) Sex Trafficking of Children.—Section 1591 of title 18, United States Code, is amended—

(1) in subsection (b)—

(A) in paragraph (1), by striking “by a fine under this title and imprisonment for any term of years not less than 15 or for life” and inserting “shall be fined under this title and punished by death or imprisoned for life”; and

(B) in paragraph (2), by striking “by a fine under this title and imprisonment for not less than 10 years or for life” and inserting “shall be fined under this title and punished by death or imprisoned for life”; and

(2) in subsection (d), by striking “shall be fined under this title, imprisoned for a term not to exceed 25 years, or both” and inserting “shall be fined under this title and punished by death or imprisoned for life”.

SEC. 3. TRANSPORTATION OF MINORS.

(a) In General.—Section 2423 of title 18, United States Code, is amended—

(1) in subsection (a), by striking “imprisoned not less than 10 years or for life”” and inserting “punished by death or imprisoned for life”;

(2) in subsection (b), by striking “or imprisoned not more than 30 years, or both” and inserting “and punished by death or imprisoned for life”;

(3) in subsection (c), by striking “or imprisoned not more than 30 years, or both” and inserting “and punished by death or imprisoned for life”; and

(4) in subsection (d), by striking “imprisoned for not more than 30 years, or both” and inserting “and punished by death or imprisoned for life”.

(b) Repeat Offenders.—Section 2426(a) of title 18, United States Code, is amended by striking “be 3 times the term of imprisonment otherwise provided by this chapter” and inserting “be punished by death or imprisoned for life”.

SEC. 4. EXPLOITATION OF CHILDREN.

Subsection (e) of section 2423 of title 18, United States Code, is amended to read as follows:

“(e) Ancillary Offenses.—Whoever, for the purpose of commercial advantage or private financial gain, arranges, induces, procures, or facilitates the travel of a person knowing that such a person is traveling in interstate commerce or foreign commerce with intent to engage in any illicit sexual conduct shall be fined under this title and punished by death or imprisoned for life.”.

SEC. 5. SELLING CHILDREN.

Section 2251A(a) is amended by striking “punished by imprisonment for not less than 30 years or” and inserting “punished by death or”.

SEC. 6. SEXUAL ABUSE.

(a) Aggravated Sexual Abuse.—Section 2241(c) of title 18, United States Code, is amended by striking “imprisoned for not less than 30 years or for life” and inserting “punished by death or imprisoned for life”.

(b) Sexual Abuse of a Minor.—Section 2243 of title 18, United States Code, is amended—

(1) in subsection (a), in the continuation text following paragraph (2), by striking “shall be fined under this title, imprisoned not more than 15 years, or both” and inserting “shall be fined under this title and punished by death or imprisoned for life”;

(2) in subsection (b), in the continuation text following paragraph (2), by striking “shall be fined under this title, imprisoned not more than 15 years, or both” and inserting “shall be fined under this title and punished by death or imprisoned for life”; and

(3) in subsection (c), by striking “shall be fined under this title, imprisoned not more than 15 years, or both” and inserting “shall be fined under this title and punished by death or imprisoned for life”.

(c) Abusive Sexual Contact.—Section 2244 of title 18, United States Code, is amended—

(1) in subsection (a)—

(A) in paragraph (3), by striking “shall be fined under this title, imprisoned not more than two years, or both” and inserting “shall be fined under this title and punished by death or imprisoned for life”;

(B) in paragraph (4), by striking “shall be fined under this title, imprisoned not more than two years, or both” and inserting “shall be fined under this title and punished by death or imprisoned for life”;

(C) in paragraph (5), by striking “shall be fined under this title and imprisoned for any term of years or for life” and inserting “shall be fined under this title and punished by death or imprisoned for life”; and

(D) in paragraph (6), by striking “shall be fined under this title, imprisoned not more than two years, or both” and inserting “shall be fined under this title and punished by death or imprisoned for life”; and

(2) in subsection (c), by striking “the maximum term of imprisonment that may be imposed for the offense shall be twice that otherwise provided in this section” and inserting “shall be fined under this title and punished by death or imprisoned for life”.

(d) Offenses Resulting in Death.—Section 2245(a) of title 18, United States Code, is amended by striking “shall be punished by death or imprisoned for any term of years or for life” and inserting “shall be fined under this title and punished by death or imprisoned for life”. <all>
