The Nuclear First-Strike Security Act of 2025

To limit the use of funds to conduct first-use nuclear strikes, and for other purposes.

Introduced May 21, 2025

Latest action (May 21, 2025) Referred to the Committee on Foreign Affairs, and in addition to the Committee on Armed Services, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned.

Summary

The bill prohibits the use of federal funds to conduct first-use nuclear strikes unless the President determines the strike is in the U.S. national interest and the Secretary of Defense certifies to Congressional leadership within seven days before the strike that the decision is valid and legal. Exceptions to the certification requirement include strikes conducted under a Congressional declaration of war, strikes in response to a nuclear attack against the United States or its NATO and key allies, and strikes during a launch-on-warning scenario based on detected incoming missiles. The bill defines first-use nuclear strikes as those conducted when neither the Secretary of Defense nor the Chairman of the Joint Chiefs have jointly confirmed a foreign country conducted a nuclear attack.
