Felony Murder for Deadly Fentanyl Distribution Act of 2025
To punish the distribution of fentanyl resulting in death as felony murder.
Summary
The Felony Murder for Deadly Fentanyl Distribution Act of 2025 amends federal law to classify the distribution of fentanyl that results in someone's death as first-degree murder. Under this bill, distributing fentanyl is defined as knowingly or recklessly distributing a controlled substance containing 2 grams or more of fentanyl (or 0.5 grams or more of fentanyl analogues) that results in death from its use. A person convicted of first-degree murder by distributing fentanyl would be subject to either the death penalty or life imprisonment. The bill applies to individuals who distribute fentanyl while knowing or having reason to know that the substance contains fentanyl.
