To amend section 505 of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 to prohibit the provision of assistance under title IV of the Higher Education Act of 1965 to States that offer in-State tuition rates to aliens who are not lawfully present in the United States, and for other purposes.

Latest action (Mar 31, 2025) Referred to the Committee on the Judiciary, and in addition to the Committee on Education and Workforce, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned.

Summary

This bill amends the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 to penalize states that offer in-state tuition rates to aliens not lawfully present in the United States. Under the bill, if the Secretary of Education determines that a state charges in-state tuition rates to undocumented immigrants at rates equal to or less than rates charged to state residents who are citizens, that state becomes ineligible for federal financial assistance under title IV of the Higher Education Act. States deemed ineligible would lose such federal higher education funding for the following fiscal year. Title IV includes federal student aid programs such as Pell Grants and loan programs.
