Protect Local Farms Act

To amend the Fair Labor Standards Act of 1938 to provide for the preemption of certain State overtime laws for agricultural employees.

Introduced Jan 7, 2025

Latest action (Jan 7, 2025) Referred to the House Committee on Education and Workforce.

Summary

This bill amends the Fair Labor Standards Act to allow federal law to preempt state overtime laws for agricultural employees. Specifically, it provides that federal law will override any state law that sets a maximum workweek for agricultural workers at less than 60 hours. The effect is that agricultural employees in states with stricter weekly hour limits would no longer be covered by those state protections, instead following the federal standard. The bill does not change federal overtime requirements themselves, only prevents states from imposing stricter limits on maximum weekly hours for farm workers.
