Protecting the Right to Keep and Bear Arms Act of 2025
To prohibit the President and the Secretary of Health and Human Services from declaring certain emergencies or disasters for the purpose of imposing gun control.
Summary
This bill would prohibit the President from declaring an emergency under the National Emergencies Act or under the Stafford Disaster Relief and Emergency Assistance Act for the purpose of imposing gun control measures. The bill also prohibits the Secretary of Health and Human Services from declaring a public health emergency for the purpose of imposing gun control. Additionally, the bill amends the Stafford Act to explicitly prohibit federal disaster relief authorities from prohibiting the possession, manufacture, sale, or transfer of firearms, ammunition, ammunition feeding devices, or firearms accessories. The effect is to prevent federal emergency or disaster declarations from being used as a basis for implementing firearms restrictions.
