Summary

This bill amends the Medicare Part D prescription drug program to create an exemption from the manufacturer discount requirement for certain orally administered drugs. The exemption applies to drugs that received FDA approval as a new drug application and have been granted a narrow exception by the Centers for Medicare & Medicaid Services allowing reclassification as a noninnovator multiple source drug under the Medicaid drug rebate program. The bill effectively excludes these specific drugs from Part D's manufacturer discount program.
