To amend the Higher Education Act of 1965 to require that any institution of higher education that is a nonprofit organization under section 501(c)(3) of the Internal Revenue Code be deemed a nonprofit institution of higher education for purposes of such Act.
Summary
This bill amends the Higher Education Act to require that institutions of higher education classified as nonprofit organizations under federal tax law (section 501(c)(3)) be automatically recognized as nonprofit institutions of higher education under the Higher Education Act. The bill ensures that institutions with federal tax-exempt status are consistently treated as nonprofit institutions for purposes of the Higher Education Act. This clarifies the definition of nonprofit institutions and eliminates potential discrepancies between tax law and higher education law.
