Supporting Farm Operations Act of 2025
To direct the Secretary of Labor to modify the implementation of the adverse effect wage rate for H-2A nonimmigrants.
Summary
This bill freezes the adverse effect wage rate (AEWR) for H-2A temporary agricultural workers at the levels in effect on December 31, 2023, through December 31, 2026, preventing wage rate increases during this period. The adverse effect wage rate is the minimum wage employers must pay H-2A workers to avoid negatively affecting domestic agricultural workers' wages. The bill also directs the Secretary of Labor to use a "primary duties evaluation" when determining wage requirements for H-2A workers who perform multiple types of tasks, basing the wage classification on their main job responsibilities rather than all duties performed.
